NORTON HORNBECK, who was last fall accused, tried, convicted and sentenced to the penitentiary for two years, for rape, was granted a new trial and brought back to Marion about the 10th of January and placed in the county jail.  Hornbeck served over five months of his sentence before a new trial was granted him.  From the very first, Hornbeck protested his innocence, and it now appears that he was innocent.  His case ws called this morning and dismissed; the judge ordering the sheriff to set Hornbeck at liberty, which he forthwith did.  When the sheriff notified the prisoner of his liberty, he said: "I am sorry to leave you, sheriff, as your kindness towards me, also that of your family, who I respect, has been very good; but I hope the Courts will do their duty with Young and Houseworth," for, said Hornbeck, "they are the lads who did the dirty work at Wyatt's last summer and then blamed me for it, as I happened to be coming that way with my peddling wagon. Houseworth is the man who was with the imbecile girl, then went to Waldo through the woods; and when the brother of the girl heard of it and came to Waldo, Houseworth turned the hellish joke on me, told the girl's brother that 'that peddler (meaning me) was the laddy-buck'; and Houseworth got on a horse, with a pistol borrowed from Young, and followed me on the road to Prospect and stopped me by pointing the pistol at me, and he (Houseworth) drunk at the time; so you see what kind of a man Houseworth is."
