Indenture between Nathaniel BURRUS and Nancy BURRUS of Todd Co., KY
Source:  Todd County, Kentucky, Deed Books K-M, 1836-40.  LDS Microfilm No. 355909 (extracted by Diana Gale Matthiesen, 21 Mar 2001).

The indenture speaks of Nancy BURRUS, "formerly the wife of" Henry T. BURRUS, with the implication that she is not a widow, but divorced.  A divorce (or desertion), rather than widowhood, would be consistent with secondary sources that universally show Henry dying in 1872 when a death date is given.

Peter THOMPSON is highlighted because he is the actual subject of my research, and this indenture is the earliest indication that Peter is deceased.  After Peter left for Missouri ca. 1827, Nathaniel BURRUS became his agent, paying taxes on Peter's (then his heirs') land in Todd County until at least 1845.

This indenture made this 7th day of June in the year of Christ 1837 between Nathaniel Burrus of the county of Todd State of Kentucky of the one part + Nancy Burrus (formerly the wife of Henry T Burrus) and William R Burrus, Sally Ellen Burrus, Verlinda L Burrus, Charles B Burrus, Mary E Burrus, Henry Clay Burrus + Nancy P Burrus (children of said Henry T Burrus) of the other part Witnesseth that the said Nathaniel Burrus for and in cocideration of the sum of Seven hundrd and twenty dollars to him in hand paid by the said Henry T Burrus (the receipt of which is hereby acknowledged) has bargained and sold and by these presents doth bargain and sell unto the said Nancy Burrus and her children William R Burrus, Sally Ellen Burrus, Verlinda L Burrus, Charles R Burrus, Mary E Burrus, Henry C Burrus and Nancy P Burrus (of Todd county Kentucky) a certain tract or parcel of land lying in the county of Todd and State of Kentucky on the waters of the west fork of Red River containing ninety acres and bounded as follows 

Beginning at a Black oak near a large sink spring at the west fork baptist meeting house corner to Peter Thompsons heirs thince with their line west 150 ples to a poplar in Reece's line thence with Reece North 68 poles

to an elm and dogwood corner to said Reece in C N Bells line thence with Bell S??E 28 poles to a white oak and poplar thence east with said Bell 49 poles to a stake corner with said Bell thence with another of his lines north 73 poles to A Stake corner to Samuel Golliday thence with Golliday E 73½ poles to a post oak + black oak saplings corner to said Golliday thence south 137 poles to the Beginning.

To have and to hold the said tract of land with its appurtenances unto her this said Nancy Burrus during her natural life and at her death to decend to her children (by said Henry T Burrus) and their heirs and assigns forever And the said Nathaniel Burrus covenants to defend the right and title of said tract as above bounded unto the said Nancy Burrus and her children against the claim of him the said Nathaniel Burrus his heirs and assigns and against the claim or claims of all + every other person or persons whatsoever (except the west fork meeting house lot deeded heretofore by said Nathaniel Burrus to the west fork baptist church) In testimory where of the said Nathaniel Burrus has hereto set his hand and seal the day and year first above written.

was this day produced to me in my office by the said grantor and acknowledged by the said grantor and acknowledged by the said Nathaniel Burrus to be his act and deed and the said Mary C Burrus being examined by me privily and apart from her husband declared that she did freely and willingly seal and deliver the said writing and wishes not to retract it and acknowledes the said writing ______ _____ and explained to her to be her act and deed and concenteth that the same may be recorded and the same is ordered to be recorded where _ fore I have truly recorded said deed to gether with this deed certificate in my office.
