This Indenture made the thirtieth day of April in the year of our lord one thousand eight hundred and three Between Andrew Straub of Penns township County of Northumberland State of Pennsylvania Yeoman and Barbara his wife of the one part, and John Raush of the Town of Freeburgh in said township county and state aforesaid Tanner of the other part.

Whereas, the Commonwealth of Pennsylvania by Patent bearing date the thirtieth day of May in the year of our lord one thousand seven hundred ninety and two Did grant unto Peter Straub a certain Messuage Tenement [___] tract of land containing two hundred and thirty acres and one hundred twelve perches and the usual allowance [???] for Roads &ac [___] in said Penns township County and State aforesaid called Heilbrun as [___] and by the patent inrolled in the Rolls Office for the State of Pennsylvania [__] in Patent Book No. 18 page 462 reference thereunto has more fully and [___] appears; And the said Peter Straub with Catherine his wife by their Indenture bearing date the seventh day of June in the same year and for the consideration therein mentioned Did convey the above land Messuage and tract of land unto their son the said Andrew Straub his heirs and assigns forever as in and by the said Indenture recorded in the office for recording of Deeds for the County of Northumberland in Book E page 444 reference thereunto being had more fully and at large appears And the said Andrew Straub (party hereto) afterwards laid out parcel of a Tract in a Town which is called Freeburg and being in divers Lots and convenient Lanes Streets and alleys as in and by the general Draft and plan thereof appears.

Now this Indenture Wittnesseth that the said Andrew Straub and Barbara his wife as well for and in consideration of the exceptions and reservations hereinafter excepted and released by the said parties as of the further consideration of the sum of eight pounds lawful money of Pennsylvania to them in hand paid by the said John Raush at and before the ensealing and delivery here of the receipt and testament whereof they do hereby acknowledge and thereof acquit and forever discharge the said John Raush his heirs and executors and administrators by these presents  Have granted bargained sold aliened enƒcoffed released and Confirmed and by these presents Do grant bargain sell alien [___] release and Confirm unto the said John Raush his heirs and Aƒsigns [___] them two Lots and pieces of Ground contiguous to each other situate

in the Town of Freeburg marked in the General Plan Numbers Eight and nine each of them being five perches front on front street and eight perches deep to Tanners Alley containing each one quarter of an acre as also a little piece of House ground adjoining the aforesaid Lot Number nine being thirty three feet front on front street and extending twenty eight feet deep to the Mill race.  Together with all and singular the Houses outhouses and other the Buildings ways woods waters water courses rights liberties privileges hereditaments and appurtenances whatsoever thereunto belonging or in anywise appertaining with such proviso exceptions and reservations hereby excepted and reserved by the said Andrew Straub that is all that race or water course built erected and made within the said two lots and pieces of ground hereby granted and sold unto the said John Raush as also free engress egress and regress to and for the said Andrew Straub his heirs and assigns to make repair and rebuilt the said race or water course as also for the amending cleaning and repairing the same with liberty and priviledge for that purpose at all convenient and necessary time or times the said race and water course hereby reserved and excepted with the ground thereto belonging shall be no more then twenty four feet and nine Inches in breadth and the length so as the same at present runs through said two lots and that without any further damage to the said John Raush his heirs and assigns.

And the said Andrew Straub for himself his heirs executors and adminstrators doth hereby covenant promise grant and agree unto and with the said John Raush his heirs and assigns that he the said John Raush his heirs or assigns shall and may at anytime or times forever hereafter if and when necessity may require take at any convient place or places so much water out of the said race or Trunk as may be sufficient to suply the Tan vats with water proportionably without any hindrance or molastation of the said Andrew Straub or any of his and to uphold the said race or water course with constant water excepting such time or times when cleaning or repairing the said race whereof timely notice shall be given by the said Andrew to the said John and such cleaning and or repairing is to last no longer than two or three days at the outside and the reversions and remainders rents Issues and profits thereof: And also all the estate right title interest property claim and demand whatsoever of them the said Andrew Straub and Barbara his wife in law or equity or otherwise howsoever of in to or out of the same.

To have and to hold the said two lots of ground as also the said piece of House ground and premises hereby granted or mentioned or intended so to be with the appurtenances [except as before excepted and reserved] unto the said John Raush his heirs and assigns to the only proper use and behoof of the said John Raush his heirs and assigns forever and the said Andrew Straub for himself his heirs executors and administrators doth covenant promise grant and agree to and with the said John Raush his heirs and assigns by these presents that he the said Andrew Straub and his heirs the said above mentioned and described two lots and use of house ground hereditaments and premises hereby granted or

mentioned or intended so to be with the appurtenances unto the said John Raush his heirs and assigns against him the said Andrew Straub and his heirs and against all and every other person and persons whomsoever lawfully claiming or to claim by from or under him them or any of them shall and will warrany and forever defend by these presents.

In Witness whereof the parties to these presents have interchangeably set their hands and Seals the day and year above written.

Received the day and the date of the above written Indenture of the above named John Raush the sum of eight pounds being the above consideration [??] in full.  Receid [?? ??] Andrew Straub. Teste F. Evans, P? Hackenberg in Northud Coy [?]

Be it Remembered that on the 15th day of June 1803 before me the subscriber one of the justices of the peace in and for said County came the above named Andrew Straub & Barbara his wife parties to the above Indenture and acknowledged the same to be their act and Deed for the purpose therein mentioned with intent that the same be recorded according to law, She the said Barbara having been first by me privately examined separate and apart from her husband and declaring that she had executed the above Indenture of her own free will and consent and without any coercion or compulsion from her said husband.  Witness my hand and seal the day and year aforesaid.
