TRIAL OF ENOCH H. YOUNG


FOR THE MURDER OF
ISRAEL BENSLEY.


AT WALDO, MARION CO., 
FEBRUARY 25TH, 1880.


EIGHTH DAY OF THE TRIAL


TUESDAY, June 22, 8:10 a.m.

Court convened and journal read — Jury called, all present, when C.R. Garberson resumed and proceeed to 'rasp' their ears, and give a desertation on the use by Dr. Christian, of a carpenter's 'hand saw', 'mallet and chisel' on the skull of Israel Bensley.

At 10:10 Cap. Scofield opened for deft. saying he was not well etc. and proceeded to read Statutes governing the case.

Captain Scofield, in his able and eloquent manner, talked for about four hours.  He done all that mortal man could do for a client, under the circumstances.  The day is hot, and the case a critical one — it's life or death with the captain's client, who seems calm and sedate.  Young's wife and child remained by his side until the Captain finished his plea.  The Captain did not get in as much of his 'gush' as usual.  After Scofield finished his plea, Young's wife, with her babe in her arms, left the court-room.

At 2:35 the main attorney for the State proceeded with his usual cool-blooded argument, at which time we left the room, as did many of the spectators.

At 4:30 — just as we go to press — the arguments closed, and Judge Beer, after patiently sitting for eight long days, is charging the jury.

The Judge finished his charge at 5:05, and the jury retired.
