THE TESTIMONY.
[CONTINUED FROM YESTERDAY.]
S.B. HOUSEWORTH.
Saw Israel Bensley take a weight up off the counter,
and the merchant said: "You better leave the weight on the counter"; saw
some one take out a new hatchet; saw Young get up and go home after
he had been knocked down; saw him come back.
Cross-examined. Had you been drinking, or was you
drunk? No sir; only took two drinks, and that was in the forenoon;
was not drunk; am a cousin of Young's by marriage.
HARVEY KENYON.
Reside in Waldo; was raised there; am acquainted with Young;
John
Smith, Coleman, and all the Waldo people; was in Waldo on 25th
of February; was at the difficulty of Young and Coleman.
Did you notice Young's condition? I did — it was like that
of a drunken man; heard all kinds of talk; can't tell exact words.
Did you hear any threats? As I said before, I heard all kinds of
talk.
Mr. Kenyon seems to have not took particular notice.
The latter part of his testimony was on the fly and hard to get him down
to business — in fact his memory North, South, East and West, and might
be thus and so, and it might not be so. Finally, when he concluded
that the attorneys had skirmished around him enough, he put a quietus on
their inquisitiveness by saying: "Isn't it customary to swear a witness
before he testifies?" This caused considrable laughter. He
was then sworn, and Captain Scofield told him to commence new and
testify over again, but Kenyon objected; said he had told
all he knew.
Wilson Coleman — I reside in Waldo; was at the fracas
Feb. 25th. [Testimony same as other witnesses.]
Cornelius Barger was next called and testified to
about the same as other had.
Dr. Holmes was re-called, but nothing new was elicited
— same as before. |
