This day came the parties aforesaid by their attornies, and said
Robt
N. Thompson produced to the Court the Instrument of writing
purporting to be the last will and testament of his deceased grandfather,
Robert
Thompson, and for proof of the same said Robert
N. Thompson and his brother Alexander
Thompson_and(sic*)
infant of the age of eighteen years, legatee in said will and sons of John
Thompson who is named in said will, they being the only subscribing
witnesses thereto and ____? to the said Robert
N. Thompson and Alexander Thompson
so much of any share in the estate of the said Robert
Thompson deceased in case said will shall not be established,
as shall not exceed the value of the legace bequeathed to them in said
will, and on the examination of sundry witnesses, and the arguments of
council on both sides having been heard and the matters and things arising
therein being duly weighed and fully understood it is considered by the
Court that said Will is not sufficiently proven and that the testator Robert
Thompson deceased at the time when said will was made was not
of a sound and disposing mind and memory, therefore it is considered by
the Court that said will be set aside and be null and void.

Archibald Edmonston and Willis Allay his securities entered into and acknowledged
bond in the penalty of two thousand dollars conditioned according to law. |
On motion of the Administrator of Robert Thompson deceased
it is ordered that William Greenfield, William Kennedy, John Morrow and
Thomas Haddon or any three of them first being first duly sworn do appraise
the personal estate and slaves if any of said decedent and report. |
